Terms and Conditions for Sere-Health

Welcome to Sere-Health, the direct-to-consumer (D2C) division of Sere-med, our medical manufacturing and distribution company. We are accredited under ISO 13485 for quality management in medical devices and licensed by the South African Health Products Regulatory Authority (SAHPRA) as a manufacturer and distributor. These Terms and Conditions (“Terms”) govern your access to and use of our website www.health.seremed.com (the “Site”), including any purchases, content, features, and services offered through the Site.

By accessing or using the Site, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site. We reserve the right to update or modify these Terms at any time, and such changes will be effective upon posting on the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

Definitions

  1. “We”, “Us”, or “Our”: Refers to Sere-Health and its parent company.
  2. “You” or “User”: Refers to any individual accessing or using the Site.
  3. “Products”: Medical or health-related items offered for sale on the Site.
  4. Other terms are defined as they appear in the text.

General Terms & Conditions:

1. Eligibility and User Accounts

  • Age Requirement: You must be at least 18 years old or the age of majority in your jurisdiction to use the Site and make purchases. By using the Site, you represent that you meet this requirement.
  • Account Registration: To make purchases or access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use.
  • Account Termination: We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

2. Products and Services

  • Product Descriptions: We strive to provide accurate descriptions, images, and specifications for our products. However, we do not warrant that product descriptions or other content on the Site are error-free, complete, or current. Products are medical or health-related items distributed in compliance with ISO 13485 and SAHPRA regulations.
  • Availability: All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion.
  • Health Disclaimer: The products offered on the Site are not intended to diagnose, treat, cure, or prevent any disease. They are for general health and wellness purposes only and do not constitute medical advice. Always consult a qualified healthcare professional before using any product, especially if you have a medical condition, are pregnant, nursing, or taking medication. The Site and its content are not a substitute for professional medical guidance, diagnosis, or treatment.
  • Regulatory Compliance: All products comply with South African laws and regulations, including those enforced by SAHPRA. We do not ship products that are restricted or prohibited in your jurisdiction.

3. Ordering and Payment

  • Order Placement: By placing an order, you offer to purchase products under these Terms. We may accept or reject your order at our discretion. You will receive an order confirmation email upon acceptance.
  • Pricing: Prices are listed in South African Rand (ZAR) and exclude taxes, shipping, and handling fees unless otherwise stated. We reserve the right to change prices at any time, but changes will not affect orders already accepted.
  • Payment Methods: We accept payments via the methods listed on our checkout page. All payments are processed securely through third-party providers. You authorize us to charge your payment method for the total amount, including applicable taxes and fees.
  • Taxes and Duties: You are responsible for all applicable taxes, customs duties, and fees. For international orders, additional charges may apply.
  • Order Cancellation: You may cancel an order before it ships by contacting customer support. We reserve the right to cancel orders due to pricing errors, unavailability, or suspected fraud.

4. Shipping and Delivery

  • Shipping Policy: We ship to addresses within South Africa. For international shipping, please contact us at serehealth@seremed.com or on our toll-free helpline: 0800 6222 20. Shipping times are estimates and not guaranteed. Delays may occur due to customs, weather, or other factors beyond our control.
  • Risk of Loss: Title and risk of loss pass to you upon delivery to the carrier. We are not responsible for lost, damaged, or delayed shipments once handed over.
  • International Shipping: For orders outside South Africa, you are responsible for compliance with local laws, including import restrictions on medical products. We comply with South African export controls and may refuse shipments to sanctioned regions.

5. Returns, Refunds, and Exchanges

  • CPA Cooling-Off Period: Under the Consumer Protection Act, you may have a 7-day cooling-off period for certain purchases, but this does not apply to medical or health products that cannot be returned for hygiene or safety reasons once opened or used.
  • Return Policy: Due to the nature of medical and health products, returns are accepted only for defective, damaged, or incorrect items received. Notify us within 7 days of receipt, and return the product in its original packaging with proof of purchase. We do not accept returns for opened or used products unless defective.
  • Refunds: Refunds will be issued to the original payment method within 14 days after we receive and inspect the returned item. Shipping fees are non-refundable.
  • Exchanges: Exchanges are subject to product availability and may require additional payment if the replacement is more expensive.
  • Warranties: Products are warranted against manufacturing defects as per the warranty documentation for each product. This warranty does not cover misuse, normal wear, or unauthorised modifications. To the extent permitted by law, all other warranties are disclaimed.
  • Nothing in this clause limits a consumer’s rights under the Consumer Protection Act, including the right to approach a court or regulator where applicable.

6. Intellectual Property

  • Ownership: All content on the Site, including text, images, logos, and trademarks, is owned by us or our licensors and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
  • User Content: If you submit reviews, comments, or other content, you grant us a non-exclusive, royalty-free license to use, modify, and display it for any purpose.

7. Privacy and Data Protection

  • Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act (POPIA) and other applicable laws. By using the Site, you consent to our privacy practices.

8. Limitation of Liability

  • Disclaimers: The Site and products are provided “as is” without warranties of any kind, express or implied. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.
  • Liability Cap: To the fullest extent permitted by law (including the CPA), we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products, even if advised of the possibility. Our total liability shall not exceed the amount paid by you for the product in question.
  • Force Majeure: We are not liable for delays or failures due to events beyond our control, such as natural disasters, pandemics, or regulatory changes.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms, misuse of the Site, or infringement of third-party rights.

10. Governing Law and Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of laws principles.
  • Dispute Resolution: Any disputes arising from these Terms shall be resolved through negotiation. If unresolved, they shall be submitted to binding arbitration in Johannesburg under the rules of the Arbitration Foundation of Southern Africa (AFSA). You waive any right to class action.
  • Jurisdiction: For non-arbitrable matters, exclusive jurisdiction lies with the courts in Johannesburg, South Africa.

11. Miscellaneous

  • Severability: If any provision of these Terms is held invalid, the remainder shall continue in full force.
  • Waiver: No waiver of any term shall be deemed a further or continuing waiver.
  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Site.

B) MyBP Terms & Conditions

Effective date: 02/09/2026
These Terms & Conditions (“Terms”) govern your use of myBP, a feature provided by Sere-med CC (“we”, “us”, “our”). By accessing or using myBP, you agree to these Terms.

1. What myBP does

myBP allows you to:

  • enter blood pressure readings (and related information) taken using your own meter or a meter provided by us; and

  • submit those readings and your doctor’s contact details; and

  • send the submitted information to your chosen doctor via email.

myBP is provided to help you share information with your healthcare provider. It does not replace professional medical care.

2. Not medical advice / no emergency use

  • myBP does not provide medical advice, diagnosis, or treatment.

  • Do not use myBP for emergencies or urgent symptoms.

  • If you feel unwell, have severe symptoms, or think you may need urgent help, contact emergency services or your healthcare provider immediately.

  • We do not monitor, review, or act on submitted readings, and no clinical review or alerting is provided unless explicitly stated otherwise

3. Your responsibilities

By using myBP, you agree that:

  • You will enter information that is accurate to the best of your knowledge.

  • You are responsible for ensuring the blood pressure reading was taken correctly.

  • You will provide the correct doctor email address and details.

  • You have permission to share the information you submit (for example, if submitting on behalf of someone else).

  • You will not use myBP to send spam, misleading information, or content that is unlawful.

4. Consent to send information to your doctor

By submitting through myBP, you:

  • consent to us sending the information you entered to the doctor details you provided; and

  • understand that email is not always guaranteed to be delivered instantly or at all (e.g., spam filters, incorrect address, mail server issues).

5. Email delivery and limitations

  • We will take reasonable steps to send the email, but we do not guarantee delivery or receipt.

  • You are responsible for checking with your doctor that the email was received if it is important.

  • If you enter an incorrect doctor email address, the email may be sent to the wrong recipient.

6. Privacy and personal information

myBP involves the processing of personal information, including health-related information.

We will:

  • use your information only to provide the myBP service and for related support and security;

  • apply reasonable technical and organisational measures to protect information under our control; and

  • limit access to authorised personnel only.

Important: Because myBP sends information via email to a recipient you choose, once the email is delivered to that recipient’s system, it may be stored or processed under that recipient’s policies and security controls. We are not responsible for the doctor’s systems.

7. Data retention

We may retain submitted information for:

  • service operation and troubleshooting;

  • compliance and audit purposes; and/or

  • security and abuse prevention.

Where possible, we will minimise retention and retain information only as long as reasonably necessary. If you want to request deletion (where applicable), contact us at: serehealth@seremed.com.

8. Acceptable use

You agree not to:

  • attempt to gain unauthorised access to myBP or related systems;

  • interfere with or disrupt the service;

  • submit harmful code, automated submissions, or abusive content; or

  • use myBP in a way that could harm others or violate applicable laws.

We may suspend or terminate access if we believe there is misuse.

9. Availability and changes

  • We may update, change, suspend, or discontinue myBP at any time.

  • We may update these Terms from time to time. The latest version will be posted on our website. Your continued use of myBP means you accept the updated Terms.

10. Disclaimer

To the fullest extent permitted by law:

  • myBP is provided “as is” and “as available”.

  • We make no warranties that the service will be uninterrupted, error-free, or that emails will always be delivered.

  • We do not monitor, review, or act on submitted readings, and no clinical review or alerting is provided unless explicitly stated otherwise

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for:

  • any medical outcomes, decisions, or actions taken based on information submitted via myBP;

  • any failure or delay in email delivery;

  • incorrect doctor details entered by you;

  • unauthorised access outside of our reasonable control; or

  • indirect, incidental, special, or consequential damages.

Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Governing law

These Terms are governed by the laws of South Africa and any disputes will be handled in the courts of South Africa unde the relevant jurisdiction, unless applicable consumer laws require otherwise.
